Data theft at Desjardins: Court approves $200m settlement

A huge reparation operation involving 9.7 million members of the Desjardins-Caisse will be carried out over the next few months.

Under the terms of the agreement, presented to Judge Claude Bouchard on May 24, Desjardins members may claim an amount based on an hourly rate of $18 up to a maximum of $90 in the event of loss of time related to the leak of personal information -Dollars and/or an amount up to US$1,000 in case of identity theft.

The judgment specifies that a total of 458 members of the Desjardins caisses preferred to exclude themselves from the amicable settlement in order to preserve their right to sue Desjardins in the event of a problem in the future.

At Desjardins’ expense millions of members were offered a credit monitoring service for a period of five years.

$8.5 million to attorneys

One of the points of contention concerned the amount Desjardins should pay to the lawyers who organized the class action lawsuit.

The latter asked for $20 million while Desjardins offered $4.8 million.

The judge ruled $8.5 million, believing they were charges fair and reasonable.
